Terms of Business
Terms of Business for SCM Funeral Directors, a company incorporated in England and Wales with company number 12636057, having its registered address at 600 College Road, Kingstanding, Birmingham, B44 0HU (“we”, “us” or “our”).
1. Estimates and Expenses
The estimate is an indication of the charges likely to be incurred on the basis of the information we know at the date of estimate. While we make every effort to ensure accuracy, charges are liable to change, particularly where third parties alter their rates. We may not always know the exact amount of third-party charges in advance, but we will provide our best estimate on the written estimate. Actual amounts will be shown in the final account. If you amend your instructions, we require written confirmation. Extra charges may apply in accordance with our current price list. VAT will be added where applicable at the rate in force when the invoice is prepared.
2. Payment Arrangements
We require a non-refundable deposit equal to the total third-party costs, payable three working days prior to the funeral. The final balance is due within seven days of our account, unless otherwise agreed in writing. The final account will be sent one week after the funeral. For Simple Funeral, Direct Cremation, and Direct Burial options, full payment must be made three working days before the funeral. Failure to pay may result in interest charges at 2% above our Bank’s base rate, calculated daily, compounded monthly, before and after judgment. We may also recover the cost of legal action to enforce payment.
3. Indemnity
You agree to indemnify us in full against all expenses and liabilities (including legal costs on a full indemnity basis) arising from your breach of these Terms. For example, we may charge an administration fee if a cheque is not honoured or if reminders are required. If debt collection agents are instructed, their fees will also be recoverable. We may claim these losses at any time and seek recovery through the courts if necessary.
4. Data Protection
As defined in the General Data Protection Regulations 2018 (“the Regulations”), we respect the confidentiality of personal data. Data will be held securely, processed for the purpose of delivering our services, and not used for marketing unless you provide express consent. To provide services, data may be shared with third parties directly involved in arrangements. You have the right to know what data we hold, and by applying in writing (with a fee) you may request copies. Signing acceptance gives us permission to retain your details. 5. Cooling-Off Period
Under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, you may cancel this agreement within fourteen days (the “cooling-off period”). If you wish services to begin before this period ends, you must sign an authority form. If you cancel within the cooling-off period, you may be required to pay reasonable costs for goods and services already provided.
6. Termination
This agreement may be terminated before services are delivered:
By us, if you fail to honour your obligations; or
By you, with written notice.
Depending on circumstances, you may be required to pay for work carried out up to the date of termination.
7. Conduct
We are a member of The National Society of Allied & Independent Funeral Directors (SAIF) and subscribe to its Code of Practice. We aim to act professionally, courteously, and with dignity. Concerns should first be raised with Stuart Smith (Director). If unresolved, SAIF provides a dispute resolution service (complaints form at saif.org.uk, email: standards@saif.org.uk, phone: 0345 230 6777). Dates and times cannot be guaranteed until bookings are confirmed. Circumstances beyond our control may affect arrangements, in which case alternative options will be provided.
8. Agreement
Your ongoing instructions confirm acceptance of these Terms. No third party may enforce these Terms under the Contracts (Rights of Third Parties) Act 1999. If any term is unenforceable, it will not affect the remainder, and may be treated as amended for enforceability. Nothing in these Terms limits our liability for death or personal injury. This agreement is governed by English law, and legal proceedings may be brought in any appropriate English court.
